The contribution analyses the notion of “fully automated decision” under Article 22 of the GDPR in light of the litigation involving the German company Schufa, first before the German administrative court and, secondly, before the Court of Justice, concerning the credit scoring system used by the company. The conclusions reached by the Court of Justice with respect to the notion of ‘fully automated decision’ are compared with the particular context of the algorithmic administrative decision, also in light of the recent approval of Regulation 2024/1689 establishing harmonised rules on artificial intelligence.
